Data Controller and Contact Details

DIBALDO S.r.l. (hereinafter "Data Controller", for the purposes of Art. 4(7) GDPR) with registered office in Via Pasquale Tosi, 302, 47822 Santarcangelo di Romagna (RN), VAT and Tax Code: 04715080406, e-mail: info@dibaldospirits.com.

What are cookies?

Cookies are small text files that the websites visited by the data subject send and store on their computer or mobile device, to then be retransmitted to the same websites upon the next visit.
Thanks to cookies, a website remembers the actions and preferences of the data subject (such as login data, preferred language, font size, display settings, etc.) so they do not need to be re-entered when the data subject returns to the website or navigates from one page to another.

Cookies are therefore used to carry out IT authentication, session tracking, and storage of information regarding the activities of users accessing a website. They may also contain a unique identifier code that allows tracking of the data subject’s navigation within the website for statistical or advertising purposes.

While browsing a website, the data subject may receive:

  • cookies sent directly by the owner and/or manager of the website (so-called first-party cookies);
  • cookies sent by third parties other than the publisher of the website visited by the data subject (so-called third-party cookies).
    Unless otherwise indicated, please note that third-party cookies fall under the direct and exclusive responsibility of their respective providers. More information on privacy and their use can be found directly on the websites of the respective providers.

Types of cookies

Based on the indications of the Italian Data Protection Authority and the opinions issued at the European level by the Article 29 Working Party (now replaced by the European Data Protection Board – EDPB), cookies can be categorized as follows:

  1. Technical Cookies

Technical cookies are necessary to transmit a communication over an electronic communications network and to provide the service requested by the data subject. They include:

  • Session or navigation cookies: cookies that are not stored permanently on the data subject's device and are deleted when the browser is closed. They are strictly limited to transmitting session identifiers necessary to allow safe and efficient navigation of the website.
  • Functionality cookies: allow remembering the website settings chosen by the data subject, such as language or privacy preferences, to improve the services and navigation experience.

For these types of cookies, it is not necessary to acquire the data subject’s prior informed consent.

  1. Analytical Cookies

Analytical cookies, as recently observed by the Data Protection Authority, can be used to evaluate the effectiveness of a service, design a website, or help measure its traffic (e.g., number of visitors, potentially divided by geographical area, connection time slot, or other characteristics).

Likewise, analytical cookies installed by third parties do not require prior consent from the data subject when direct identification of the data subject (so-called single out) is not possible. To avoid the use of direct and unique identifiers, such cookies must:

(i) refer not to one, but to multiple devices, creating reasonable uncertainty regarding the digital identity of the subject receiving them (e.g., via masking appropriate portions of the IP address);
(ii) be used exclusively to produce aggregate statistics and may only be used in connection with a single website or mobile app, without enabling user tracking across different platforms or websites.

Additionally, it is clarified that third parties providing web measurement services must not combine the minimized data with other processing (e.g., customer files or statistics from other sites) or disclose them to other third parties—unless statistics refer to multiple domains, websites, or apps.

Consent is required for third-party analytical cookies without data minimization safeguards.

  1. Profiling Cookies

Profiling cookies are used to associate specific actions or recurring behavioral patterns in using the functions offered (patterns) with identified or identifiable data subjects, in order to group various profiles into homogeneous clusters of variable size, and to deliver increasingly personalized services or targeted advertising messages—i.e., in line with the data subject’s browsing preferences.

The installation of profiling cookies and the resulting data processing is optional; consent is required for this type of cookie.

Consent is also required for mixed cookies (i.e., cookies installed and used for multiple purposes beyond technical or analytical functions).
